Terms of Service
These terms cover your use of Park Pulse, an app for iPhone, iPad and Apple Watch (including its widgets and Live Activities). Please read them. They're written to be short and plain.
Park Pulse is an independent app. It is not affiliated with, endorsed by, sponsored by, or otherwise connected to The Walt Disney Company or its affiliates. Disney, Walt Disney World, park, land and attraction names are trademarks of their respective owners and are used only to identify the places the information refers to.
1. Who we are and agreement
Park Pulse is made by Steven Fatone, an individual developer ("I", "me"). By downloading or using Park Pulse, you agree to these terms. If you don't agree, please don't use the app.
2. Apple's standard EULA
Park Pulse is distributed through Apple's App Store, so Apple's Licensed Application End User License Agreement (the "Apple EULA") applies to your use of the app. These terms add to the Apple EULA. If they conflict on a matter that involves Apple, the Apple EULA governs.
These terms are between you and me, not Apple. Apple is not responsible for the app, its content, maintenance or support, or for handling any claims about it.
3. Your licence
I give you a personal, non-exclusive, non-transferable licence to use Park Pulse on Apple devices you own or control, for your own non-commercial use, as allowed by the Apple EULA. I keep all rights in the app that aren't expressly given to you.
4. Park Pulse Pro
- Park Pulse Pro is a one-time, non-consumable in-app purchase. It is not a subscription and does not renew.
- Purchases are processed by Apple. Payment, billing and refunds are handled by Apple under its terms. To request a refund, use Apple's "Report a Problem" page or contact Apple Support; I can't issue refunds directly.
- If you reinstall the app or move to a new device signed in to the same Apple Account, use Restore Purchase in the app's Settings to unlock Pro again.
5. Information is provided as-is
Wait times, park hours, show times, forecasts, routes, walking times and recommendations in Park Pulse are estimates based on third-party data. They can be wrong, incomplete or out of date, and attractions can close or change without notice.
- Don't rely on Park Pulse for safety decisions.
- Always check official park sources, posted signs and Cast Members for current information.
- Height checks are a convenience only. The height requirements posted at each attraction, and the decisions of park staff, are what count.
6. Independence, trademarks and data source
Wait-time, park-hour and show-time data comes from the public ThemeParks Wiki API. Thank you to that project for making it available. ThemeParks Wiki is also independent of the parks and is not responsible for Park Pulse.
7. Acceptable use
When using Park Pulse, please don't:
- copy, modify, distribute, sell or rent the app;
- reverse engineer, decompile or disassemble the app, except where the law allows it despite this restriction;
- scrape or bulk-extract data through the app, or use it to build a competing data service;
- use the app in a way that breaks the law or interferes with the app or the services it relies on; or
- try to get around the in-app purchase to unlock Pro features.
8. Availability and changes to the app
I may change, add or remove features, or stop offering the app, at any time. Park Pulse depends on third-party data and on Apple's services, so parts of it may be unavailable from time to time, and I can't promise it will always work or always be available.
9. Termination
Your licence lasts until you or I end it. It ends automatically if you break these terms. You can end it at any time by deleting the app. When it ends, you must stop using the app. Sections 5, 6 and 10 through 12 continue to apply after termination.
10. Disclaimer of warranties
To the extent permitted by law, Park Pulse is provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. I don't warrant that the app will be error-free, uninterrupted, or that its information will be accurate.
If the app fails to conform to a warranty that the law requires, you may notify Apple, and Apple may refund the purchase price of the app (if any). To the maximum extent permitted by law, Apple has no other warranty obligation for the app.
11. Limitation of liability
To the extent permitted by law, I won't be liable for any indirect, incidental, special, consequential or punitive damages, or for lost time, missed rides, lost enjoyment, lost data or other losses, arising from your use of or inability to use Park Pulse or from reliance on its information. My total liability for any claim relating to the app is limited to the amount you paid for Park Pulse Pro (if any).
Some places don't allow some of these limits. Where that's the case, they apply only as far as the law allows, and nothing in these terms limits rights you have that cannot be waived.
12. Governing law
These terms are governed by the laws of the State of Florida, USA, without regard to its conflict-of-law rules, except where the law of the country you live in requires otherwise.
13. Changes to these terms
If these terms change, the updated version will be posted on this page with a new "Last updated" date. Continuing to use the app after a change means you accept the updated terms.
14. Contact
Questions, support requests or claims about the app should go to me, not Apple.
